As summer draws to a close here in Victoria, it’s the perfect time to reflect on the safety and compliance of our pools and spas. Ensuring that your pool or spa meets the necessary safety standards is not just a legal obligation but a crucial step in protecting your loved ones.
The Importance of Pool and Spa Barrier Compliance
In the year leading up to 30 June 2024, Australia tragically lost 15 children under the age of five to drowning incidents, with half of these occurring in private swimming pools. These heartbreaking statistics highlight the vital role that compliant and well-maintained pool and spa barriers play in safeguarding our children.
In Victoria, the Building Regulations 2018 mandate the registration of all private swimming pools and spas, along with the installation of compliant safety barriers. This legislation aims to reduce the risk of unsupervised access by young children, thereby preventing potential tragedies.
Understanding the Legal Requirements
All swimming pools and spas on residential properties in Victoria with a depth greater than 30cm (300mm) are required to be surrounded by a safety barrier. This includes inflatable pools. The specific requirements for these barriers vary based on the construction date of the pool or spa:
• Before 8th April 1991: Barriers must prevent direct access from the house or any building.
• Between 8th April 1991 – 30th April 2010: Barriers must prevent direct access from the house, garage, or any outbuilding.
• After 30th April 2010: Four-sided barriers are required, with no direct access from the house or any other building to the pool or spa area.
Additionally, pool and spa owners are required to:
• Register their pool or spa with the local council.
• Have the safety barrier inspected every four years by a registered building surveyor or inspector.
• Lodge a certificate of barrier compliance with the council, confirming that the safety barrier meets all regulatory requirements.

The Role of Regular Inspections
Regular inspections are a cornerstone of maintaining a safe pool or spa environment. They ensure that all safety barriers are in good condition and comply with current standards. Neglecting these inspections can lead to non-compliance, which not only poses safety risks but can also result in significant fines.
As a VBA Licensed and Police Checked Pool and Spa Barrier Inspector, I bring a wealth of knowledge and experience to each inspection. Being fully insured for Public Liability and Public Indemnity, I am committed to providing thorough and reliable services to ensure your pool or spa is safe for all family members.
Common Issues Leading to Non-Compliance
Through my experience, I’ve identified several common issues that often lead to non-compliance:
• Inadequate Barrier Height: Barriers must be of a certain height to prevent young children from climbing over.
• Climbable Objects Near the Barrier: Items like furniture, trees, or shrubs near the barrier can provide footholds for children.
• Faulty Gates or Latches: Gates that don’t self-close or self-latch properly can allow unsupervised access.
• Gaps or Openings in the Barrier: Openings that are too large can allow children to slip through.
Addressing these issues promptly is essential to maintain a safe environment.
The Inspection Process
At Rules for Pools and Barriers, we strive to make the inspection process as straightforward and stress-free as possible:
1. Initial Consultation: We discuss your current pool or spa setup and any concerns you may have.
2. Pre-Inspection Survey: We offer a pre-inspection survey, which can be conducted via Zoom or by reviewing photos and videos you provide. This step helps identify potential compliance issues before the formal inspection, saving you time and money.
3. On-Site Inspection: We conduct a thorough on-site inspection of your pool or spa barrier, checking for compliance with all relevant safety standards.
4. Report and Recommendations: If any issues are found, we provide a detailed report with recommendations for rectification.
5. Issuance of Compliance Certificate: Once all requirements are met, we issue a Certificate of Barrier Compliance (Form 23), which you must lodge with your local council within 30 days.
