Understanding the Legal Requirements

All swimming pools and spas on residential properties in Victoria with a depth greater than 30cm (300mm) are required to be surrounded by a safety barrier. This includes inflatable pools. The specific requirements for these barriers vary based on the construction date of the pool or spa:
• Before 8th April 1991: Barriers must prevent direct access from the house or any building.
• Between 8th April 1991 – 30th April 2010: Barriers must prevent direct access from the house, garage, or any outbuilding.
• After 30th April 2010: Four-sided barriers are required, with no direct access from the house or any other building to the pool or spa area.

Additionally, pool and spa owners are required to:
• Register their pool or spa with the local council.
• Have the safety barrier inspected every four years by a registered building surveyor or inspector.
• Lodge a certificate of barrier compliance with the council, confirming that the safety barrier meets all regulatory requirements.

• Gaps or Openings in the Barrier: Openings that are too large can allow children to slip through.
